So is the line for cost incurred the fact they receive an invoice? I thought it was the client has actually paid the bill and was literally out of pocket the amount for the claim
It’s a highly debatable issue. A “PAID IN FULL” invoice is obviously the best thing
Didn’t help when Franchises decided to take that 50% cut to get on a vendor list NOT EVEN an exclusive list. Project Managers n others in management screaming romantically to the industry and clients. WE’LL WORK WITH YOUR CARRIER AND YOU DONT HAVE TO WORRY. Now as an owner of an independent company, ignorance and lack of liquid capital turned me into a snack to carriers. A few years ago I went back to old school contracting thanks to advice from my old construction manager and I stopped letting the customer off the hook. Thanks to Andy as well replaying in my head with that same message, the client is still the responsible party. 🤘🏼🤘🏼🤘🏼awesome video
Clear enough
Maybe show how to rotate the symbols??
Thank you for this video Andy!
What’s a typical late fee % per month to charge thanks
Typical doesn’t exist. What does your contract say?

What is ATI
American Technolgy Inc, they are a family owned, national restoration company.
Listening from NJ, slight thunderstorm going on
The knowledge base documents, such as industry whitepapers and position statements, consistently emphasize that Overhead and Profit (O&P) are legitimate and necessary components of the billing for restoration work. Here are some key points highlighted across various documents: 1. **Nature of Restoration Work**: O&P covers general business expenses and profit margins necessary for the sustainability of a restoration business. These include administrative costs, staff salaries, equipment maintenance, and other operational costs that aren't directly billable to a single project but are essential for running a business【24†source】【25†source】. 2. **Industry Standards**: The documents assert that O&P should be factored into cost estimates as standard practice. This aligns with the broader construction and insurance industries, where O&P are recognized components of total job costs to ensure companies maintain financial health and can reinvest in their businesses【28†source】. 3. **Insurance Practices**: There is criticism of insurance practices that attempt to exclude O&P from restoration invoices, especially when such exclusions are based on arbitrary criteria like the number of trades involved in a project. The position papers argue that such practices are not in line with fair and reasonable compensation for work performed and can lead to underpayment for services that adequately restore properties to their pre-loss condition【26†source】【27†source】. 4. **Legal and Contractual Obligations**: The documents often mention that insurers are legally and contractually obliged to pay for all reasonable and necessary restoration costs, which include O&P. Excluding these costs can lead to disputes and potential legal challenges【24†source】【25†source】. 5. **Adjuster and Contractor Interaction**: There is emphasis on the necessity for clear communication and mutual respect between adjusters and contractors. Contractors are encouraged to assert their rights to include O&P in their billing, particularly when their contracts with the insured do not limit such inclusions【31†source】. Overall, the knowledge base strongly supports the inclusion of Overhead and Profit in restoration billing, advocating for fair compensation practices that recognize the full scope of expenses and efforts involved in providing restoration services.
Can I ask where your source footnotes lead?

Will Anthony be coming on the show more? I'd like to see more of him.
Carriers still doesnt care if it says we can deviate from standard prices. They are using it to pay undisputed payments.
Wow thank you!
You're welcome Brian
@@AndrewMcCabeI’m going for my wrt next week and asd in June and was very informative. I’ve been doing this for 5 years now (30yo) and it’s always good to learn some extra thinking for the field and xactimate. Hopefully own my own business one day.
Profiting off an insurance claim is illegal.
Try again. Betterment and moral hazard are illegal. Collection of O&P on covered repairs is not.
Iam in Florida talk about helping us here with dealing with carriers. Please
Thank you for great content 💪💪 I appreciate you guys!
Really great tips Joe. Will definitely be stealing these! Also enjoyed the nerd talk on calculating the soda cleanup. ;)
I've had state farm for nearly 20 years. Never once filed a claim until last year. State farm has been delaying, denying, lying to me, attempting to gaslight and harassed me the entire time... In an attempt to make me give up or go away. Due to their egregious tactics for avoiding coverage for a valid claim. Which multiple contractors and experts have confirmed. I now have $150,000-$200,000 in property damages, from State Farm's negligence. If they had agreed to extend coverage and pay when this happened a year ago it'd only be $10,000 max. letting the damage fester has led to my house becoming uninhabitable. I've suffered permanent bodily injury as a result of what State Farm ordered me to do. As a part of their damage mitigation for this whole time. State Farm has put the repairs on hold 1/5th of the way through the demo stage. Asking me to give them a new copy of every document they were given 4x over already. Then insisting on sending out a 7th field adjuster. While already vehemently accusing me of causing all the damage from their delays and denials instead. The contractors have directly written to, and reported that State Farm's delays led to the extensive damage. I've complied with everything they instructed of me the entire time. Spent 4-6 hours a week on the phone in an attempt to remedy the situation with State Farm. All to no avail with each adjuster making up different excuses. They haven't sent me the documents required by law on multiple occasions either. Ignoring some of my emails texts and phone calls. Never giving me a straightforward answer on anything. Even now I'm on my 3rd contractor and they are still trying to blame me. Despite the fact they have reports from 11 contractors all saying similar or the same things. I'm fed up and no longer interested in working with them on a solution. They destroyed my house and through gross negligence and caused irreparable bodily injury to my person. Now I have to begin an daunting process of filing a lawsuit with my attorney against State Farm.
Do you own a Restoration Company?
No. I’ve run several over the years
yesindeed
❤
If you dont respond they will issue the undisputed payment and then we have no options to negotiate or get more money unless we file lawsuit. But here in Florida if the customer got paid and we only got unpaid 5k for example no attorney will take over file. Ita a complicated subject for us in Florida and they know that.
Great job! I've had car insurance with State Farm for 40 years and only one claim for something that wasn't my fault, a deer. From 2022 to 2023, on the same vehicle (no accidents, no tickets, no nothing but me paying them every six months) my ins almost doubled...from $230 every six months to $400. That was a 2000 Jeep Cherokee...just got a new Toyota Corolla LE and they want over $1200 every six months for it. Pure theft I say.
❤
Thank you!!
Any insurance company would think you are a psycho. Just because you are able to send a reply to their response so quickly
Well, I AM crazy. Like a fox

See you in Dallas!
Very good session. I was interested in the discussion involving Tim Fuller regarding his conversation with Wardlaw. Is there a follow up with specific details on how he prevailed against Wardlaw?
it's the future with the way the carriers are taking direction lately..
I admire this guy.❤🎉
If you move away from Xactimate what will you replace it with. Core logic NO In my current opinion. customize the pricing
That's the thing. There is no good alternative. It's Xact, or everyone goes back to long-hand estimating in quickbooks.
Interested in Xactimate classes.
Do I really have to watch Lou on mute, at the gym lookin like he's trying to pinch a loaf?

What about Florida?
Ha first thumbs up…..hey Andy… you’re the man…
No AOB In Texas ?
PRO at work
In Florida is not how much you can prepare the invoice for. Its what you can do to win an argument with peer reviews. Additionally here the carriers are just paying undisputed amount without opportunity to negotiate. They do that due to no AOB.
Good word! 😁
Hey Andy. How do I get in the the round table discussion live?

Andrew, the value you bring to the industry is massively under-represented based on these UA-cam numbers.
Thank you?
